Texas Street Rod Law (HB 890)

I couldn't find a thread on this, so if there is one, please point me in that direction. I tried a search, but couldn't find it.

Gov. Perry signed a SEMA model bill which suits me perfectly. The definition of street rod is exactly how my '33 is titled in Virginia. I was dreading the title process when I finally return from Italy and set up retirement in Texas. :D

Unfortunately, the Texas DMV is ignoring the 01 SEP 11 starting date and telling the county bubbas to continue as is until the "kinks" are worked out. I assume part of the problem is deciding how and how much to tax us. :mad:

Anyone have more current news?

there is much going on on this.

using black book for values ..... not good
no more title searches done by the county for titles .
using bonded titles . good but the title is open for 3 years but someone having a title for it is very unlikely.

at least now we can title a car for the year it represents not when it was built. it may come down to having a car looked at as they intend to stop the fraud of undervaluing a car when doing a title.

Mine is a street rod built up from parts. Gibbon body, Pete & Jakes frame, etc. I have a valid Virginia title that says 1934 Ford (Replica) dated 2007, and it says "Sales Tax Paid" on the title. I can't imagine there is a need for bonded title in this case. Also, there is no personal property tax on vehicles in Texas, correct?

I'm not moving to Texas until I leave Uncle Sammy's employment in Italy until 2013. I hope they have it sorted out by then.

only tax will be when it changes hands. you should have no problem.

Jack you are right,they don't know the value of a particular vehicle. Will take some time before that is worked out. A law passed a couple of years ago list what the vehicle being sold is worth then they charge you a 6.25 % fee.

When I was building the coupe I had to pay the 6.25 % on the chassis cost as it was the only document titled to it. The parts body,etc. I brought in later from out of state I paid no tax. When I sold the coupe ( 3 wks. ago) a value was declared as they have no value list completed on these cars. This new law helps in some ways and hinders in others.

Don, the move date should be spring of 2013 when I retire from DoD (NAVFAC). We well be living north of Dallas in the Frisco area. Actual location TBD.

I appreciate the opportunity to respond to your email regarding implementation of HB 890, legislation relating to street rods and custom vehicles.


The legislation authorizes the issuance of a new “custom vehicle” and “street rod” specialty license plate. In addition, it allows for the model year and make that the vehicle resembles to be listed on the vehicle title. Finally, the law requires the Texas Department of Motor Vehicles (TxDMV) to create a safety inspection process for a “custom vehicle” and a “street rod.” It exempts a “custom vehicle” and a “street rod” from the current safety inspection requirements.

The TxDMV is currently working with its partners and stakeholders on the creation and implementation of the new safety inspection program. As you can probably imagine, this is a very challenging and complex project that will require a great deal of effort in order to ensure that an effective program is created and implemented. As a result, it will take several months to implement the provisions of this law. Please be assured that the TxDMV is working diligently to ensure that this law is implemented effectively and in a timely manner.

BTW, I'm not sure why the safety inspection program would be so "challenging and complex." Many states already have one. Perhaps they could read one of those. Virginia simply uses their standard inspection program.

Just be glad that the "Feds" don't have a hand in it and probably someday some bright "bean counter" will come up with some garbage to make life more miserable than it already is.

They have already done this antique car taxing in Illinois . I Paid the Tax on My 1965 Mustang got the Title in My Name cool . 8 Months Later a Letter came for there assumed value Tax . No debating already a Late fee added if you want to challenge it you have to go to Court in Springfield it said bring a Lawyer . Not sure how they broke down the Taxes . But they had My car Valued at over 20K hit me for about $900.00 Bill . I talked to a Lawyer he said they do it Because they can . I did write them back with a Bill of sale and said they can buy My car for Half of what they say it's worth . Yes still waiting for a reply and My Money back .

There are so many different levels/values a car can be built to, I'd hate to have someone just pick a number and tax me.

I'm assuming that a part of it has to do with getting a specialty (antique/Street rod) plate. What would happen if you just plated the car as a normal driver (say in the case of the Mustang)? It should be old enough to be emissions exempt, and as I recall Ill doesn’t require a safety inspection.

No Plates Title only . But I hear that Illinois will soon have Antique Plates that you can use daily From May 1st - Oct-31 . The way it is now they are for driving to Car Shows and some road testing / Fueling up only . Lot's of Guy's use to buy them because of No EPA Testing .

Say what??only use them for shows,etc??Yeesh..that sucks..I hope our government doesnt get into this garbage..We may have a strict set of guidelines we have to build to,,but at least we can drive our rods/customs/old cars daily,if we want to..:eek:

Luckily, Texas does not tax vehicles based on value, i.e., no personal property tax. Since I have a title that matches the new Texas law, all I have is the standard registration fees and a $90.00 new resident fee.

I would never move back to Illinois. Laws and politics are totally influnced by Chicago, which is completely out of touch with the rest of the state.

When I am assigned a project, I normally set a timeline that is agreeable with my boss. Apparently Texas DMV doesn't work that way. I thought I would pass the information along anyway.

The downside is that until the inspection program is finalized, street rods have to be licensed/titled according to the old process.

The upside is that it's still about 20 months until I move.

yup, just a short drive around the lake. this road work on 982 comin outa princeton has ben a bugger but it will be nice when its done. have you noticed all the dang traffic around here in the past few years. wow, where did all these folks come from.noodlin is legal now too. look out cat fish !!
