Question for techinspector1

I have a small obstacle to overcome. Hope you can shed some light . I'm installing cage tubes and came across the rule [You can't cut into the Forward Cross Member/Foot Brace]. I had planned to notch the 2''x3'' tube to allow for 4" exhaust. But that's a no no I see by the rules. Greg (An official @ Rt 66 works @ the Chevy Dealership just 2 blocks from me. He's great about giving me pointers, but is off today. I talked to him last night and he said he would bounce my dilemma off a tech guy. Later last night i came up with this idea of turning the 2''x3'' tube on it's side (Or using a 2''x2'' tube if I can. This set-up would mean a 1" rise in the floorboard @ the cross brace but would give me the needed clearance for the exhaust. I may be able to weld the cross brace flush with the top of the main frame rail, but then it gets pretty tight for the exhaust. I'm sure I'm not the first to run into this? Is there a better way to do this than my idea in the drawing below and would this pass tech?? I'm open to ideas.
I plan to dump the exhaust through the rocker panel in front of the back bracket, so that 1 isn't an issue. Thanks for your input.
